Subject and product details
The subject of this agreement is the pieces in your bag at the time of the order, whose characteristics and price are stated on their product pages. The product name, quantity and total shown in the order summary form part of this agreement.
Prices are shown in Turkish lira, VAT included. They are refreshed against the exchange rate at intervals; the price you see when you confirm your order is the price that applies to that order.
Payment
- Method
- Credit or debit card, single payment. Payment is taken through VakıfBank's virtual POS with 3D Secure verification.
- Card details
- Your card number, expiry date and security code (CVV) go straight to the bank and are not stored in the seller's systems.
- When you are charged
- The full amount is taken from your card the moment 3D Secure verification completes. No pre-authorisation is used.
Delivery
- Carrier
- LOOMİS Özel Kargo ve Güvenlik. Shipments are carried insured and handled as valuables.
- Shipping cost
- No shipping charge applies to deliveries within Türkiye.
- Delivery address
- The address given with the order. The buyer is responsible for its accuracy.
- Maximum delivery period
- Each piece is delivered within the statutory thirty days at the latest, depending on how far the buyer lives from the workshop. If the seller fails to perform within that period, the buyer may terminate the agreement.
- Pieces held in stock
- Prepared in the atelier and handed to the courier once payment is confirmed. Any date shown on a product page as an “estimated delivery date” is an estimate and carries no commitment.
- Made to order and out of stock
- Pieces that are not in stock but can be ordered ship within 2–4 weeks in Türkiye and 6–8 weeks abroad. For bespoke sizes and personalised work the time depends on the piece. In both cases an estimated delivery date is given by email or telephone within two working days of the order. The statutory thirty-day ceiling applies in these cases too.
- Exceptional circumstances
- If delivery cannot be made within thirty days because of exceptional circumstances — severe weather, earthquake, flood, fire — the seller informs the buyer, who may cancel the order or wait until the circumstances have passed.
Right of withdrawal
The consumer may withdraw from this agreement within fourteen days of receiving the goods, without giving any reason and without penalty. Notice of withdrawal can be given through any of the channels on the Contact page.
- Giving notice
- Notice of withdrawal is given by email to [email protected] or by telephone on 0530 305 53 07. It must reach the seller within the fourteen days.
- Returning the piece
- The piece is sent back within ten days of the notice, and in any event within fourteen days of delivery.
- Cost of return shipping
- If you return the piece with the seller’s contracted courier, LOOMİS Özel Kargo ve Güvenlik, no shipping or delivery charge is asked of you and the parcel travels insured. If it is sent with any other courier, the return shipping cost and any damage in transit are the buyer’s.
- Condition of the returned piece
- The piece must be sent back complete and undamaged, with its original box, packaging, any standard accessories and anything gifted with it. Its certificate, the delivery note, any insurance forms and the original invoice must be included, with the return section of the invoice completed and signed. Without these, the price, its VAT and other statutory charges cannot be refunded.
- Changes from ordinary use
- You are not liable for changes or deterioration that occur while you use the piece in accordance with its operation, technical characteristics and instructions during the withdrawal period.
- Refund
- The price is refunded within fourteen days of the notice reaching the seller, by a means appropriate to how you paid and at no cost to you. Where the refund goes to a credit card, your bank may take up to three weeks to show it on your account. For instalment purchases the bank returns the refund in instalments.
When the right of withdrawal does not apply
The right of withdrawal cannot be exercised for the following. These exceptions apply only where the piece was identified as such before the order was placed.
- Pieces prepared to the consumer’s own specification or personal requirements: items engraved with a name or text, full-eternity bands, wedding bands made to a measured size, nose jewellery, fingerprint pieces and the like.
- Pieces made personal by alteration or addition: a ring size other than those selectable in the catalogue, a change of bracelet size, engraving, production with a different stone and similar requests.
- Campaign items and items in the outlet category.
- Goods whose price depends on fluctuations in financial markets and is outside the seller’s control.
- Goods whose protective packaging, tape, seal or wrapping has been opened after delivery and which cannot be returned for reasons of health or hygiene.
- Goods that become mixed with other goods after delivery and cannot by their nature be separated.
- Pieces used other than in the ordinary way.
The size and colour options selectable on the product pages are not bespoke production; your right of withdrawal is unaffected when you order with them. The exception covers special orders placed through customer services for a size or a piece of work the catalogue does not offer.
Disputes
For disputes arising from this agreement, the Consumer Arbitration Committees at the consumer's place of residence have jurisdiction up to the monetary thresholds published annually by the Ministry of Trade, and the Consumer Courts above them.
